Drug paraphernalia

MOUNT CARMEL - Wayne S. Spahr, 55, of Bellefonte, was charged by Patrolman Jonathan McHugh with possessing drug paraphernalia (a glass pipe with burnt residue), driving under suspension and restriction on alcoholic beverages relating to an incident at 1:15 a.m. Thursday in the 100 block of East Fourth Street.

So even though he said he had his marijuana card they still arrested him? How is that possible?
